Description

This training will define harassment/discrimination/retaliation/abusive conduct, explain the laws surrounding different forms of harassment, guide managers in promoting a solid anti-harassment or “zero-tolerance” policy, and discuss ways to document harassment for an effective investigation by your company’s Human Resources department.

After completing this course, managers will know how to respond to and identify sexual harassment and will also understand their role in preventing sexual harassment. Employers and managers must be well-versed in understanding how to protect employees from situations that involve harassment. This information is critical in avoiding a hostile working environment, costly litigation, reputational damages, and considerable penalties.

NYC Local Law 96 (2018) requires that the training include, at a minimum, the below elements:

1. An explanation of sexual harassment as a form of unlawful discrimination under local law;
2. A statement that sexual harassment is also a form of unlawful discrimination under state and federal law;
3. A description of what sexual harassment is, using examples;
4. Any internal complaint process available to employees through their employer to address sexual harassment claims;
5. A description of the complaint process available through the NYC Commission on Human Rights, the New York State Division of Human Rights and the United States Equal Employment Opportunity Commission, including contact information; The prohibition of retaliation, pursuant to subdivision 7 of section 8-107, and examples thereof;
6. Information concerning bystander intervention, including but not limited to any resources that explain how to engage in bystander intervention; and
7. The specific responsibilities of supervisory and managerial employees in the prevention of sexual harassment and retaliation, and measures that such employees may take to appropriately address sexual harassment complaints.

 

Course Objectives

Upon completion of this course, you should be able to:

  • Distinguish between discrimination, harassment, and retaliation and identify various forms harassment can take in the workplace (including harassment based on gender identify, gender expression, or sexual orientation).
  • Understand the laws that protect victims against sexual harassment.
  • Explain how to recognize sexual harassment situations.
  • Identify your Employer’s responsibilities in recognizing or preventing sexual harassment.
  • Understand how to draft a formal complaint record.
  • Understand your options in filing a charge of discrimination with federal (Equal Employment Opportunity Commission), state anti-discrimination and harassment agencies (Department of Human Rights), and local agency (New York City Commission on Human Rights).
